Managing and minimizing taxes in a real estate sale is of crucial importance to investors and Realtors. This will continue to be the case as the government increases taxes in order to offset record spending levels. Section 1031 of the Internal Revenue Code is one of the greatest tools available to property owners to achieve greater returns through reduced capital gains tax liabilities. Avoiding the Blame Game

Avoiding the Blame Game will review contract writing, and how thorough and thoughtful drafting can avoid Realtor liability. We will explore areas that can result in Realtor liability, such as: fraud; failure to disclose; mistake; personal injury; and criminal liability. We will review real cases where Realtors have been found liable for a buyer or seller’s damage, and we will discuss how these issues could have been avoided. We will also review the agency duties that are imparted on Realtors and explore how to effectively uphold said duties. Attendees will leave with a better understanding of the pitfalls of their practice, and how to avoid suits or claims in the future.

During this course licensees will identify the major ethical issues and problems within their industry.

Dodd-Frank to the Rescue & TRID

What are the Federal requirements that regulate
settlement procedures pertaining to residential
mortgage loans? After reviewing the development of these regulations over time, we will delve into the development of the Dodd-Frank Act, the Consumer and Financial Protection Bureau, and their new regulations to TILA and RESPA. We will review the new requirements for the Loan Estimate and Closing Disclosure that took effect on Oct. 1, 2015, and we will discuss what realtors can do to aid creditors and settlement agents in their work. Table Manners Getting to the Closing Table and Staying There

Students will learn what each party must provide and perform to get to the closing table, and will be
refreshed on what their responsibilities are as sellers’ or buyers’ agents. We’ll discuss issues that can delay a closing and how to avoid them-including the new 2015 federally mandated loan disclosures. We will review
updated Iowa law and the NAR Code of Ethics to determine how to best update realtor’s practices for compliance. Register online before 11/14/16. Fee $40
